Terms and Conditions

Please be advised that by sending a deposit or full payment to FUSION TRAVEL ECUADOR, you are accepting the Terms and Conditions listed below, both for yourself and on behalf of each member of your travel party. No signature(s) is (are) necessary.

The first clause pertains to the participants.

1 The company FUSION TRAVEL ECUADOR, legally represented by Mr. Segundo Conlago, shall henceforth be referred to as the «AGENCY».
2 The individual engaging the services of the AGENCY shall be referred to as the «TOURIST».
3 The third-party company operating the contracted tours shall be referred to as the «OPERATOR».

The second clause sets out the obligations of the parties.

The Agency

-The objective is to provide the best operators in the market, offering the best value for money. All operators must be legally established and authorised to operate in accordance with Ecuadorian law.
– To provide all necessary information to the tourist about their contracted travel destination/tour.
3.3 To provide the tourist with all necessary tickets and vouchers for participation in the tour.
– To contact the family, insurance company and/or embassy of the tourist in the event of an accident caused by circumstances beyond our control. The agency accepts no liability for any injuries, death or other damage caused by the tourist or operator, regardless of the circumstances.

The Tourist

-To have clearly understood and accepted the inherent risks associated with travel within Ecuador. This includes the risks of injury or death associated with unforeseeable circumstances such as wars, civil unrest, protests, terrorism, fire, natural disasters, public authority decisions, accidents, or any other extreme and unforeseen circumstances. Furthermore, the participant acknowledges and accepts the risks associated with the practice of extreme sports, including but not limited to mountain biking, rafting/tubing, climbing, mountain sports, trekking, camping, rappelling/canopy ziplining, horseback riding, snorkeling, diving, and any other activity or sport where there is contact with nature. The tourist acknowledges and accepts that the agency will not be held liable for any loss, injury or damage to person or property arising from the aforementioned causes.
-To hold valid and comprehensive travel insurance covering the booked travel dates, or, in the absence of such an insurance policy and having no intention of obtaining one, to declare the AGENCY exempt of all responsibility for any kind of accident, death, injury or physical Any issues that arise during the course of the contracted trip, including financial responsibility for trip cancellation or curtailment, loss of luggage, trip delays, medical coverage, emergency evacuation or repatriation, or any other inconveniences outside of the control of the AGENCY.
-To ensure that all immigration documents, a valid passport and the necessary vaccinations are in order, in accordance with Ecuadorian law.
-To inform the AGENCY in advance of any special dietary requirements, disabilities or illnesses that may exist at the time of travel.
-To be in sufficient good health and fitness to take part in the trip that is reserved. In the case of visiting high altitude destinations, it is the responsibility of the tourist to be sufficiently acclimatised to perform the visit safely.

The third clause outlines the payment terms for the tour.

-Please be advised that a 40% deposit payment is required to be made to the agency within a maximum period of one week (7 days) from the original booking date. In the event that a reservation is made less than 91 days prior to the scheduled departure date, the full tour payment is required within one week (7 days) of the original booking date.

-The full balance of the tour fare must be paid no later than 90 days prior to the tour departure date. Should this not be the case, the AGENCY reserves the right to treat the booking as cancelled by the TOURIST and to apply the relevant cancellation charges, as set out in clause six. Tickets will only be issued to the tourist once the agency has received full payment.
-The agency will only accept bank payments made into our official corporate accounts under the name of TOUR OPERADORA FUSIONTRAVEL CIA. LTDA. It will not accept or recognise any payments made into any other third-party bank account.

FOURTH CLAUSE – CONFIRMATION OF TOUR

-The reservation made by the tourist is legally confirmed by the agency only after receipt of either the 40% deposit payment or the full tour payment from the tourist, as per clause 3.
-The AGENCY agrees to make all necessary payments to local OPERATORS in a timely manner to ensure the correct reservation and operation of the tour.

In the event that the tourist wishes to cancel their tour, the following clause shall apply:

– Any cancellations by the client must be made in writing and will only be effective once the agency has received the written document. In the event that the tourist chooses to cancel their tour for any reason, including those outside of the tourist’s control, such as illness or death of the tourist or a family member, flight cancellation, missed flights, natural disasters, adverse weather conditions, terrorism or adverse government travel recommendations, the following cancellation clauses will apply.
-In the event that the client cancels their booking more than 120 days prior to the trip’s commencement, a cancellation fee of 25% of the total tour value will be applied per person.
– If the cancellation is received between 91 and 119 days prior to the trip’s commencement, a penalty fee of 40% of the total tour value will be charged per person.
-In the event that the client cancels their booking less than 90 days prior to the scheduled commencement of the tour, they will be liable for a cancellation fee equal to 100% of the total tour value.
– Please note that alternative cancellation fees apply to the following Galapagos cruises: The following vessels are subject to alternative cancellation fees: Daphne, Grand Queen, Beatriz, Eden, Monserrat I, Yolita II, Samba, Seaman, Santa Cruz II, Isabela II, La Pinta, Letty, Origin, Theory, Hermes, Aggressor III, Humboldt, Tiburon Explorer. Please note that for cruises booked on any of the vessels listed, clauses 6.2, 6.3 and 6.4 will not apply. It is the responsibility of the tourist to check the specific cancellation terms before booking.

-CHARTER CRUISES: Please note that charter cruise cancellation terms may differ from the regular cancellation terms listed in clauses 6.2 to 6.5.It is the responsibility of the tourist to check with the agency prior to making a booking for a charter.
– TRIP CANCELLATION INSURANCE: It is highly recommended that the tourist purchase a policy that will cover them for cancellation of the tour for any reason, as well as for any other losses incurred as a result of the cancellation. In the absence of an insurance policy and without the intention of obtaining one, the tourist agrees to exempt the agency from responsibility for all cancellation losses incurred and to refrain from initiating a credit card chargeback process against the agency.
-TRIP POSTPONEMENT: In the event of a request for postponement of the tour by the tourist, the aforementioned cancellation fees will still apply unless the operator agrees to forfeit the fee.
